(Provided, That the "applicant" and the "Respondent" shall order the payment of damages for delay calculated at the rate of 15% per annum from the day following the delivery of the duplicate of the complaint of this case to the next day of the delivery of the copy of the complaint of this case under the statutory interest rate of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, which was amended and promulgated by Presidential Decree No. 26553, Sept. 25, 2015; and which exceeds the above scope of recognition, are dismissed) based on the judgment without pleading which was based on the recognition on February 2, 200 (Article 208(3)1 and Article 257 of the Civil Procedure Act).
