A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

Persons liable for military service who have left Korea before being transferred to the first militia service shall obtain permission for extension of their period or permission for overseas travel by January 15 of the year in which they turn 18 years of age.

Nevertheless, the defendant left Canada before being transferred to the first citizen service around October 1995 and did not obtain permission from the Commissioner of the Military Manpower Administration until January 15, 200 for the year when he turns 18 years of age.
