2. All state power, including the judicial power of this Court, to the facts charged in the instant case, should be exercised for the people, and the power should be exercised for the people.
Therefore, judges who exist in order to realize the rule of law by delegation of judicial power from the people have the constitutional responsibility to judge according to the Constitution, laws and professional conscience.
The professional conscience of judges is formed by the provisions such as the Constitution and laws, or by the customary law, established legal principles such as the Supreme Court precedents, and the sound social common sense that is disadvantageous to social norms such as social practice.
This professional conscience is the core value of the judge who cannot waive it in any case as the inherent area of the judge, which is the last part of the realization of the rule of law society.
