피고인은 피해자가 침대가 있는 대기실인 F 방으로 들어가자 따라 들어가 피해자를 침대에 앉게 한 뒤 왼손으로 피해자의 목을 조르고, 오른손으로 그곳에 있던 위험한 물건인 쇠정(길이 35cm, 증 제1호)을 들어 탁자를 치며 피해자를 때릴 듯이 위협하며 "니는 내 시키는 대로 안 하면 죽이고 교도소 간다."라고 말하고, 이에 피해자가 "내는 이리 함부로 하면 안 됩니다. 장애인이라서 더 처벌받습니다."라며 고함을 치며 반항하자, 이불로 피해자의 입을 막고 "시키는 대로 안 하면 죽는다."라며 손으로 피해자의 뺨을 때리고, 발로 복부를 수차례 걷어차 피해자의 반항을 억압한 후, 피해자가 입고 있던 바지와 팬티를 모두 벗기고 상의를 걷어 올려 입으로 피해자의 가슴 부위와 음부를 빤 후, 피해자를 1회 간음하여 강간하고 이로 인하여 장애(뇌병변 장애 3급)가 있는 피해자에게 약 3주간의 치료가 필요한 전신 좌상 등의 상해를 가하였다.
