1. The Defendants are jointly and severally liable to the Plaintiff for KRW 75,00,000 and 24% per annum from February 6, 2018 to November 22, 2018.
The Plaintiff did not dispute the Defendants’ joint and several liability to Defendant B with an agreement of KRW 30,00,000 per annum, interest rate of KRW 30,000 per annum, KRW 15,00,00 on July 26, 2014, KRW 15,000 per annum on November 6, 2014, and KRW 30,000 per annum on March 16, 2017; KRW 10,000 per annum on April 7, 2015; KRW 30,000 per annum on October 7, 2015; KRW 30,000 per annum on July 2, 2016; KRW 30,00 per annum on July 26, 2016; and KRW 14,00,000 per annum on March 14, 2017; and KRW 301,57,201, per annum on each of the Defendants’ joint and several liability.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff 75 million won and damages for delay calculated at the rate of 24% per annum within the agreed rate from February 6, 2018 to November 22, 2018, the delivery date of a copy of the complaint in this case, and 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from the following day to the date of full payment.
If so, the plaintiff's claim is justified.
