피고인은 경기 화성시 B에 있는 주식회사 C을 운영하면서 안전인증대상 전기용품인 케이블(IV 1.5~6㎟, HIV 0.5~2.5㎟, VCTF 0.75~2.5㎟ 등)을 직접 제조하는 사람이다.

그럼에도 불구하고 피고인은 2013. 9. 23.경 위 장소에서 안전인증대상 전기용품인 시가 1,625,000원 상당의 케이블(CVF, 2.5㎟) 약 50롤을 안전인증을 받지 아니하고 제조한 것을 비롯하여 그때부터 2014. 3. 18.경까지 사이에 별지 범죄일람표(1)에 기재된 것과 같이 총 128회에 걸쳐 같은 방법으로 안전인증을 받지 아니하고 안전인증대상 전기용품을 제조하였다.

2. No manufacturer of electrical appliances subject to safety certification and the packaging thereof shall place a safety certification mark or any similar mark on electrical appliances subject to safety certification and their packaging without obtaining safety certification;

그럼에도 불구하고 피고인은 2013. 1. 3.경 위 장소에서 안전인증대상 전기용품인 시가 1,150,000원 상당의 케이블(CVF, 1.5㎟) 약 50롤을 제작하면서 사실은 안전인증을 받지 아니하였음에도 ‘HH01061-8003A'라고 임의로 안전인증 번호를 표시한 것을 비롯하여 별지 범죄일람표(2)에 기재된 것과 같이 그때부터 2014. 3. 18.경까지 사이에 총 527회에 걸쳐 안전인증을 받지 아니하고 안전인증대상전기용품과 그 포장에 안전인증의 표시 등을 하였다.
