The Defendant is a person who operated an Internet education service company under the trade name of “D” in Seocho-gu Seoul Metropolitan Government C Building from August 2009 to May 2012.

On March 17, 2011, the Defendant posted a notice on the “D” Internet website (E) stating, “The last day of this day is 75% discount period for 12 weeks of establishment, and the next discount is 4 years later. In addition, each school’s academic process can be known in detail with independent technology connected to each school server, and each school’s educational process can be identified, and the examination problem is high, and at the time of entrance, it will exempt the victim F who reported the above site from KRW 205,500 at the time of entrance.” On February 17, 2012, the Defendant made a false statement to the effect that “The last day of the discount period is the last day of each school, the server is installed for each school, and the teacher’s tendency is identified, and provides customized issues by identifying the tendency of each school.”

However, the facts are 30,00 won, 350,000 won, 40,000 won, and 450,000 won as stated on the homepage, and the defendant had revised and posted a notice as if the last day of the 75% discount event every day in order to promote the invitation of members, and the defendant did not have an independent technology connected to the school server, and there was no intention or ability to provide customized services every day to identify the tendency of each school and to raise problems corresponding thereto.

As above, the Defendant, by deceiving the victim F and receiving KRW 350,00 from the victim on February 17, 2012, received KRW 350,00 from the victim under the name of information usage fees, etc., and received KRW 13,120,00 from November 23, 201 to May 31, 201, as stated in the separate crime list from around 23, 201, under the pretext of information usage fees, etc.
