A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Punishment of the crime
1. The Defendant violates the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc. (the Act on the Punishment of Arrangement of Commercial Sex Acts, Etc.) is a person who operates a commercial sex acts establishment of approximately 38 square meters with the trade name of “E” on the southyang-si C and D2 level, three rooms installed with a sculp and bed, three rooms installed with a bed, and one waiting room for employees.
On August 18, 2014, the Defendant: (a) around 23:30 on August 18, 2014, assisted female employees F to engage in sexual intercourse with customers by receiving KRW 120,00 from customers; and (b) assisted female employees by receiving KRW 100,00 or KRW 120,00 from many unspecified customers from around January 2014 to August 18, 2014.
Accordingly, the defendant committed commercial sex acts such as arranging commercial sex acts.
2. No person who violates the School Health Act shall conduct business in a school environmental sanitation and cleanup zone where he/she is likely to conduct physical contacts, such as dancing, peting, composting, etc., exposing sex-related body parts, or to conduct sexual intercourse or similar acts by dividing it by smuggling, closed space or partitions, etc. or by other similar facilities therein;
Nevertheless, from January 2014 to August 18, 2014, the Defendant installed a guest room equipped with simple beds and shower facilities in a space partitioned with about 100 meters away from school environmental sanitation sanitation cleanup area at the Mapo Elementary School, and operated a sex act as provided in paragraph (1).
