1. The original copy of the judgment with executory power over the Defendant’s claim for the purchase price against the Plaintiff by this Court 2013Mo10873.
According to the purport of Gap evidence Nos. 1 through 4 and the whole arguments, the defendant's holding of claims against the plaintiff according to the judgment of this court 2013da10873, and the defendant's application for a compulsory auction (C) at this court to execute the above claim. The plaintiff has deposited all of the defendant's credit amount of KRW 45,715,029 and execution expenses of KRW 1,485,020.
The defendant's claims were all extinguished upon the plaintiff's repayment deposit.
Therefore, this Court's decision to suspend compulsory execution on August 28, 2015, against the plaintiff of this Court 2013da10873, which rejected compulsory execution based on the executory exemplification of the judgment with executory power of claim for the purchase price, and this Court approves the decision to suspend compulsory execution on August 28, 2015.
The plaintiff's claim is justified, and the costs of lawsuit are assessed against each party in order to prevent the unauthorized repetition of disputes between the parties. It is so decided as per Disposition.
