1. The defendant shall pay 152,00,000 won to the plaintiff and 12% per annum from March 23, 2019 to the day of complete payment.
Comprehensively taking account of the purport of the entire pleadings in the statement Nos. 1 and 2-1, the Plaintiff is obligated to pay the Defendant the amount of KRW 20,000,000 as of June 14, 2016, and KRW 132,00,000 as of September 6, 2016, and there is no evidence to acknowledge the interest agreement on each of the above loans. Thus, the Defendant is obligated to pay the Plaintiff the amount of KRW 152,00,000 in total (= KRW 20,000,000) and the damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from March 23, 2019 to the date of complete payment.
Therefore, the plaintiff's claim of this case is justified within the scope of the above recognition, and the remaining claim is dismissed as it is without merit. It is so decided as per Disposition.
