1.The part concerning the principal lawsuit in the judgment of the court of first instance shall be modified as follows:
The Defendant-Counterclaim Plaintiff (Counterclaim).
A principal lawsuit and a counterclaim shall be deemed simultaneously.
1. Basic facts
A. 1) The Plaintiff purchased the land listed in attached Forms 1 and 2 from C and the land listed in attached Forms 1 and 2 from D (hereinafter the land listed in attached Forms 1 and 1 and 2 as “each of the instant land”; and when specifying each of the instant land, “the instant land 1 and 2”
(2) On January 10, 2010, when the Plaintiff did not complete the registration of ownership transfer with respect to each of the instant land under its own name, the Plaintiff entered into a contract with the Defendant on the following terms (hereinafter “instant sales contract”) with respect to “refinite concrete, Class II neighborhood living facilities, and multi-family houses” to be newly built by the Plaintiff on each of the instant land and its ground.
With respect to the nature of the instant contract, the part concerning each of the instant land in the instant sales contract is “sale”, and the part concerning the construction of a new building was reflected in the specific content (structure, material, etc.) agreed with the Plaintiff and opened the possibility of the Defendant’s request being reflected, and thus, it is reasonable to deem that it is “contract”. For convenience, the instant sales contract is “instant sales contract”
Sales amount: 1,240,000 won: 20,000 won shall be paid at the time of a contract, and 100,000 won shall be paid at the time of the transfer of land ownership, and 120,000,000 won shall be paid at the time of completion of the second floor, 100,000 won shall be paid at the time of completion of the structural works, and 115,000,000 won shall be paid for the surveillance of the outer works.
Any balance: 400,000,000 won shall be paid as bank loans after the completion of the registration of the building, and 385,000,000 won shall be paid as rental deposit.
Article 3 The seller is obligated to pay interest, public charges, etc. until the balance is paid.
Article 4. The seller shall pay to the buyer all documents which can change its name when he receives any balance.
Article 5 The standard amount of lease shall be based on the data of attachment (information).
Provided, That the maximum of 3% per household shall be 3%.
