The judgment below

Examining the reasoning in light of the record, the lower court was justifiable to reverse the conviction of the first instance court on the ground that there is no evidence of crime as to the fraud among the facts charged in the instant case, and to have rendered a not guilty verdict. In so doing, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
