1. The part of the judgment of the court of first instance against the plaintiff corresponding to the money ordered to be paid below shall be revoked.

Reasons

1. The following facts may be acknowledged in full view of the purport of the entire pleadings in each entry in Gap evidence 1 to 12, and Eul evidence 1 to 14, unless there is a dispute between the parties or in full view of the purport of the whole pleadings:

The defendant is a school foundation that establishes and operates Cuniversity, etc. established for the purpose of general education and higher education.

1. The term of a labor contract: From January 1, 2015 to December 31, 2017 (three years);

7. Wages: An annual salary system shall be wages, and a separate annual salary contract shall apply to an annual salary;

8. Termination and renewal of employment contracts;

(a)the contract shall be automatically terminated upon the expiration of the term of the contract;

However, if there is an agreement between the defendant and the plaintiff due to the necessity of the defendant, the contract may be renewed.

(b) even during the term of the employment contract, if there is an unexpected or similar event in connection with the performance of duties, or if it is found that there is a serious lack of capacity to perform duties, the employment contract may be terminated in the middle of the case falling under the “reasons for Termination of the Supervisory Contract” in separate lots, and the remaining amount of the annual salary after the termination date shall not be paid.

B. On January 1, 2013, the Plaintiff, who was employed by the Defendant from around January 2013, served as a supervisor of C University Camp. On January 1, 2015, the Plaintiff entered into a re-employment contract (hereinafter “instant employment contract”) with the Defendant with the following content:

C. The main contents of the annual salary contract attached to the instant employment contract and the “reasons for termination of the supervision contract” are as follows.

1. The term of a labor contract: January 1, 2015 to December 31, 2015;

2. An annual salary of KRW 75 million is based on 12 months (365 days), and thus a monthly salary shall be paid by the period of the contract.

3. Details of monthly salary: 6,250,000 won.

4. The method and calculation period of payment shall be deposited in a deposit passbook on the 25th of each month.
