Punishment of the crime
The defendant is the representative of Daejeon Metropolitan City Co., Ltd., a chartered bus transportation company located in Daejeon Jung-gu.
On August 8, 2014, the Defendant purchased E-Stop buses from D for KRW 89 million, but it was difficult to operate the business continuously due to the continuous management difficulties, and on February 2, 2016, the Defendant entered into a contract with G to pay KRW 64 million monthly rent for KRW 800,000 (excluding four major insurance premiums for G drivers, various taxes, tolls, etc.) from G.
1. No transport business operator who violates passenger transport business shall have another transport business operator or any person who is not a transport business operator operate passenger transport business with or without compensation by using any or all of the commercial automobiles;
Nevertheless, from February 2016 to February 2018, the Defendant had G operate passenger transport business using the E-tax bus registered in the name of the Co., Ltd. (C) under the condition that he/she received approximately KRW 800,000 per month from G, not a transport business operator, from G, on condition that he/she received approximately KRW 80,000 per month from G.
2. From March 2018, when the victim G, who was the actual owner of the E charter bus, was unable to conduct the business of transporting the said bus to and from work at a F place of business any longer with the said bus, the Defendant attempted to purchase the said bus from the victim of the said bus at KRW 10 million, but he was able to steal the said bus from the victim following the continued dissenting opinion on the terms and conditions of the contract.
On June 1, 2018, the Defendant: (a) driven a bus of KRW 10 million at the market price, which is the victim’s possession of that bus parked at that place, using a key posted on the bus between the bus and the bus, and then stolen it, as it is, by using the key posted on the bus between the bus and the bus.
