A shall be punished by a fine for negligence of KRW 4,000,000, and by a fine of KRW 10,000,000.

The above fine is imposed against the Defendants.

1. Defendant B is the representative director of the “C organic farming association” and Defendant A is the director of the “C organic farming association,” and Defendant A is the director of the “C organic farming association,” who is the actual manager of the Gyeonggi-do, Gyeonggi-gun (3,164 square meters), E (1,956 square meters), F (1,817 square meters), G (206 square meters), H (20 square meters), H (620 square meters), I (1,238 square meters), and J (782 square meters), a person who intends to divert farmland, outside the agriculture promotion area, must obtain permission from the Minister for Food, Agriculture, Forestry and Fisheries.

Nevertheless, from April 2012 to October 2012, the Defendants used farmland for the use of off-camping site, play ground, parking lot, swimming pool, etc., and used farmland of a total size of 9,783 square meters outside the above D and six parcels.

2. Defendant B who violates the Building Act is the representative director of the “C organic farming association” and intends to construct or repair a building outside the urban area, shall obtain permission from the Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu, and the person who intends to alter the purpose of the building shall obtain permission from the Governor of a Special Self-Governing Province

Nevertheless, Defendant B, without obtaining permission from the competent authority on December 2, 201, constructed a kitchen of 64 square meters in size with a light steel structure in Gyeonggi-do, Gyeonggi-do. Around April 201, Defendant B extended a boiler room of 25 square meters in size to the following parts of the warehouse in the above F, and extended a signboard installation stand of 22.96 square meters in size with a light steel structure connected to the warehouse and the toilet (non-forest facilities), and extended two warehouses of 98 square meters in size with a general steel structure to the area of 98 square meters in size, and extended a warehouse of 13.5 square meters in size to the side of the building in Gyeonggi-do.

B. In addition, on April 2012, Defendant B, without obtaining permission from the competent authority, changed the use of storage facilities of the size of 98 square meters in the area F of Gyeonggicheon-gun, Gyeonggi-do into a soup, shower, and shower, the second floor into a store, a rest room, and changed the use of storage facilities of the area of 131.6 square meters in K to a private house.
