1. The judgment of the first instance, including the claims modified and added in the trial with respect to the principal lawsuit and counterclaim, is as follows.
1. Basic facts
A. The plaintiff is a company with the purpose of electrical products, pharmaceutical products manufacturing, housing site preparation projects, housing projects, etc., and the defendant worked for the plaintiff from January 1, 1987 to May 1, 1998.
B. The real estate listed in the separate sheet Nos. 1 through 17 (hereinafter referred to as “each of the instant land”) was originally owned D. However, as to the land listed in the separate sheet Nos. 1 through 5, and the land listed in the separate sheet No. 1 through 17 (hereinafter referred to as “instant land, etc.”) the ownership transfer registration was completed in the Defendant’s future on March 20, 1989 on the ground of sale on January 3, 1989. As to the land listed in the instant No. 6 through 10, 12, and 17 on April 10, 1985, the ownership transfer registration was completed on November 1, 1994 pursuant to the former Act on Special Measures for the Registration, etc. of Ownership of Real Estate (Act No. 4502, invalidation, and hereinafter referred to as the “Special Measures Act”). < Amended by Act No. 4781, Nov. 1, 1994>
C. The Plaintiff holds a registration certificate on the land of this case 1 to 5 and 11, and the Defendant holds a registration certificate on the land of this case 6 to 10, 12 to 17.
On March 20, 1989, the Defendant delivered to the Plaintiff a letter of commitment that the Plaintiff waives all of the rights to ownership and use of the instant land. Around December 1992, the Defendant agreed to set up the right to collateral security in the Plaintiff’s name with respect to each of the instant land, and issued a blank mortgage contract and a certificate of seal impression to the Plaintiff.
E. Around August 1996, the Defendant filed a building report under the name of the Defendant on the instant paragraph (11), and newly constructed real estate listed in attached Table 18 (hereinafter “instant building”) through a contract with the construction business entity. The said building was completed on April 18, 201, and the registration of ownership was completed on May 7, 2001.
On the other hand, on April 7, 2008, the defendant's building stated in attached Table 19 on the land of this case as of April 7, 2008.
