1. The Defendants shall jointly and severally pay to the Plaintiff KRW 239,897,949 and the interest rate thereon from February 27, 2018 to the date of full payment.
1. Indication of claim;
A. The Plaintiff is a corporation engaged in steel manufacturing and wholesale business from 256-gil 4, Sii-si Corporation 2 to 256.
B. The Plaintiff sold steel products to C (hereinafter “C”) and C sold goods to C Co., Ltd. (hereinafter “C”).
C delivered, in order to pay the price for the goods to the Plaintiff, the promissory notes endorsed in sequence by three and three.
Upon the settlement of the above Promissory Notes, the Defendants jointly and severally guaranteed the goods payment obligations against the Plaintiff on July 3, 2017.
C. C paid part of the price for the above goods to the Plaintiff, and the price for the goods unpaid until December 1, 2017 is KRW 239,897,949.
Therefore, the Defendants are jointly and severally liable to pay to the Plaintiff the amount of KRW 239,897,949 as well as damages for delay calculated at the rate of 15% per annum from the day following the date of final delivery of the instant complaint to the day of full payment.
2. Articles 257 and 208 (3) 1 of the Civil Procedure Act of the judgment without holding any pleadings.
