The Defendants shall jointly and severally pay to the Plaintiff KRW 131,00,000 and the interest rate from January 29, 2020 to the day of complete payment.
According to the overall purport of evidence Nos. 1 through 5, the Plaintiff supplied ready-mixeds equivalent to KRW 156,00,000 to E (hereinafter “E”) from July 2017 to August 2017, and Defendant C and D jointly guaranteed the Plaintiff’s obligation to pay back-mixeds, and Defendant B Co., Ltd (hereinafter “Defendant Company”) concluded on June 20, 2019 to pay KRW 151,000,000 to the Plaintiff.
According to the above facts, the defendants are jointly and severally liable to pay to the plaintiff 131,00,000 won remaining after deducting 20,000,000 won (=151,000,000 won - 20,000 won) and damages for delay calculated at the rate of 12% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, etc. from January 29, 2020 to the date of final delivery of the copy of the complaint of this case sought by the plaintiff.
Therefore, the plaintiff's claim against the defendants is justified, and all of them are accepted, and it is so decided as per Disposition.
