The prosecution of this case is dismissed.
1. On June 22, 2017, the Defendant: (a) around 17:00 on June 22, 2017, on the street in front of Sungnam-gu, Sungnam-gu, Sungnam-gu, as a result of a sales contract with the victim D; and (b) committed assault by having the victim’s body sealed several times with his/her shoulder.
2. Determination and conclusion
(a) Applicable legal provisions: Article 260(1) of the Criminal Act;
(b) Crimes of non-violation of intention: Article 260 (3) of the Criminal Act.
C. On November 27, 2017, after the prosecution of the instant case, the “written application for an agreement and a written application for non-prosecution of punishment” stating the purport that “the injured person does not want punishment of the Defendant” was submitted to this court.
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
