1. The Defendant deposited 3,593,100 won out of KRW 8,383,90,00 deposited by the Changwon District Court for the year 2010 gold No. 5437, Nov. 29, 201.
1. The facts below the basis of facts are either in dispute between the parties or in accordance with Gap evidence Nos. 1 and 2, taking into account the overall purport of the pleadings.
A. The Defendant admitted 203 square meters (hereinafter “the instant land”) before Changwon-si’s window D, Changwon-si, while executing the river repair work in the Nakdongdong-dong Ggdong-gu Ggdong-gu Ggdong-gu Ggdong-si, and deposited KRW 8,383,900 for the instant land on November 29, 2010 on the ground that the inmate was unknown.
(hereinafter referred to as the "Deposit of this case").
The land in this case is unregistered and written in the land cadastre on December 15, 1964, as the ownership preservation, owner E, and address smuggling.
On December 20, 2010, the Defendant completed registration of preservation of ownership on the instant land.
2. Determination
A. The facts below the facts are found to be without dispute between the parties, or acknowledged in full view of the overall purport of the arguments in relation to Gap's evidence Nos. 3 through 8, 11, 15 through 19, and 21, the head of the Chang-si Office of this Court, the head of the Chang-si Office of this Court, and the head of G in Gyeyang-si
1) On November 30, 1922, the instant land was divided into H, 1750 square meters, Changwon-gun, Changwon-gun, and 1750 square meters, and on November 30, 1913, H land before the said division was restructuringed into G pages-gun (JJ area) on November 30, 1913.
(ii) was assessed against E, whose address is the address, and (ii) the owner is E, and the address of E is written as C/W and C/W.
3) On August 16, 1976, a public official who belongs to the window in Changwon-si entered the existing land cadastre of the instant land into "K" as the name of the same person, the name of the resident registration number of the owner E, who was in official column, in the process of transferring it to the card form land cadastre on August 16, 1976, and erroneously entered the entry as "the change of address on January 1, 193, 193" as "the preservation of ownership on December 15, 1964" that "K, the resident registration number of which is "K", has not been residing in the I or Syang-gun F, and the plaintiff and the plaintiff who are deemed to be below.
