The judgment below

Examining the reasoning in light of the records, it is justifiable for the court below to maintain the judgment of the court of first instance that acquitted the Defendant on the facts charged of this case (excluding the part which found the Defendant guilty in the judgment of the court below) on the grounds as stated in its reasoning, and contrary to what is alleged in the grounds of appeal, there is no violation

Meanwhile, although the prosecutor appealed to the entire judgment of the court below, the part of the conviction did not state the grounds for appeal, and the appellate brief does not state the grounds for appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
