Reasons

1. Basic facts

A. 1) The Plaintiff entered into a lease agreement between the Plaintiff and the Defendants as indicated in the separate sheet (K Building; hereinafter “instant building”).

(2) On December 31, 2013, the Plaintiff leased Defendant C Co., Ltd. (hereinafter referred to as the “Defendant Co., Ltd.”) the part of the ship’s 36.36 square meters (hereinafter referred to as “one store”) connected each point of the attached drawings No. 19, 20, 21, 22, 23, and 19, among the 1st floor of the instant building, by designating the lease period as “from January 1, 2014 to December 31, 2014,” “eight million won per month,” and “rental deposit KRW 90,000,000”.

3) 원고는 같은 날(2013. 12. 31.) 피고 회사에게 이 사건 건물 2층 중 별지 제3도면 표시 22, 23, 24, 25, 22의 각 점을 차례로 연결한 선내 ㉺부분 33.06㎡(207호, 이하 ‘제2점포’라 한다

)를 ‘임대기간 2014. 1. 1.부터 2014. 12. 31.까지’, ‘월 차임 108만 원’, ‘임대보증금 1,080만 원’으로 정하여 임대하였다. 4) 원고는 2013. 8. 22. 피고 F 및 제1심 피고 G에게 이 사건 건물 1층 중 별지 제2도면 표시 32, 33, 34, 35, 32의 각 점을 차례로 연결한 선내 ㉴부분 21.49㎡(106호, 이하 ‘제3점포‘라 한다)를 ’임대기간 2013. 9. 1.부터 2013. 12. 31.까지‘, ’월 차임 393만 원‘, ’임대보증금 5,200만 원‘으로 정하여 임대하였다.

After that, the lease agreement was renewed by December 31, 2014.

B. Article 19 of the Lease Contract concluded between the Plaintiff and the Defendants is subject to a special agreement, in cases where “A” sells this building to another person or the rebuilding or remodelling works are extended, and there are unavoidable circumstances, such as: (a) A may terminate this contract by giving written notice to B before two months; and (b) B, without raising any objection thereto, ordered the leased object immediately.
