The prosecution of this case is dismissed.
Reasons
1. Around May 11, 2018, the Defendant, at around 19:25, assaulted the victim C (42 years old)’s breath by drinking in the “Modin Green Park,” a 83-ro, Mansan-ro, Mansan-ro, Masan-ro, 19:25, without any reason, on his/her own.
2. The judgment is the case falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. Since the victim expressed his/her intention not to prosecute the defendant on August 22, 2018, the prosecution of this case is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
