1. The Defendant did not have the intent or ability to pay the credit amount to the victim or to repay the borrowed money to the victim because of the absence of certain occupation or property at the time, in order to raise the cost of living, by borrowing money from the victim or disposing of precious metals purchased on credit from the victim.

A. On November 28, 2009, the Defendant would pay the victim the precious metal sales amount with the amount of money that would be paid to the employees to operate the restaurant with internal employees at the music house operated by the injured party on the first floor of E department stores in Suwon-si, Suwon-si, Suwon-si. < Amended by Presidential Decree No. 21140, Nov. 28, 2009>

‘Falsely speaking, one of them was delivered to the injured party at the market price of KRW 140,00 on the same day from the same day, and received precious metals equivalent to the total market price of KRW 39,425,00 from November 28, 2009 to February 10, 2010 in all of 53 times from November 28, 2009 to February 1, 201.

B. On January 29, 2010, the Defendant calls to the victim and “it is necessary to promptly write down documents by the son.”

"A false statement" was remitted 2,00,000 won to the agricultural bank account in the name of the defendant's living in the name of the defendant for the same day from the damaged person.

On April 2, 2010, the Defendant called the victim and received compensation from the victim with money that he/she was unable to receive the compensation.

"A false statement" was remitted 300,000 won to the said Agricultural Cooperative Deposit Account on the same day from the injured party.

2. The Defendant: (a) the victim F should lend money to the victim by making a false statement in order to raise the cost of living due to the absence of certain occupation or property at the time; and (b) the Defendant borrowed money from the victim
