1. The Defendant’s KRW 40,239,00 for the Plaintiff and KRW 6% per annum from December 1, 2013 to May 6, 2015.
On July 31, 2003, the Plaintiff acquired membership on the date of full payment of the membership deposit when entering into an interest rate membership agreement with the Defendant on July 31, 2003, and the period for holding membership for ten years thereafter. If the Plaintiff disclosed his intention of withdrawal from the expiration date to the expiration date from 30 days before the expiration date, the Defendant agreed to refund the membership deposit to the Plaintiff; the Plaintiff paid the amount of KRW 40,239,000 to the Defendant until November 30, 2013; and the Plaintiff requested the return of the membership deposit upon filing an application for withdrawal from the Defendant on November 7, 2013; thus, there is no dispute between the parties, and the Defendant does not have any obligation to pay the Plaintiff the remainder of the annual interest rate of KRW 40,239,00 and the delay damages calculated from December 1, 2013 to May 6, 2015, which is the original copy of the payment order of this case.
Therefore, the plaintiff's claim is accepted within the scope of the above recognition, and the remaining claims are dismissed as they are groundless.
