On July 24, 2012 and August 13, 2012, the Defendant was sentenced to imprisonment with prison labor for ten months and fines for two million won at the Gwangju District Court on January 2, 2013, and two years of suspended execution. The above judgment became final and conclusive on January 10, 2013.

Upon the commencement of probation during the period of probation, the defendant had a good appraisal against the victim, as the victim C (here, 50 years of age) made a statement about the damage during the probation period.

그러던 중 피고인은 위 집행유예 및 보호관찰 기간이 종료된 직후인 2015. 1. 19. 12:00경 광주 북구 삼정로 두암주공 2차 아파트 상가 앞을 지나다가 피해자 C를 발견하자 피해자로 인하여 자신이 처벌받게 되어 괘씸하다는 이유로, 피해자에게 ‘니미 씹할 좆같은 년아, 잡년아 너 가만히 둘 것 같냐, 나 접근금지도 보호관찰도 법적인 문제도 다 끝났다, 너 때문에 교도소 생활하고, 너 때문에 피해가 엄청나게 많으니 가만두지 않겠다. 죽여버리겠다’고 말하고, 계속하여 자신을 피해 위 아파트 상가 2층으로 올라간 피해자를 향해 큰 소리로,'고발해라, 접근금지 , 경찰 고소 , 에이 니미 씹아 해라, 나야 접근금지 다 끝났어, 왜 이런식으로 나를 못살게 하냐, 느그들 때문에 내가 씨발년아 징역살이 하고 염병도 했는디, 콱 니미 씨발, 내가 느그한테 사기를 쳤냐 뭐 했냐, 이런 니미 씹들아, 이런 니미 콱'이라고 소리치는 등 마치 피해자의 생명이나 신체에 어떠한 위해를 가할 듯이 행세하여 약 30분 가량 피해자에게 겁을 주었다.

Accordingly, the defendant threatened the victim with the purpose of retaliationing C who made the victim's statement in connection with the investigation or trial of criminal cases against himself.
