1. The Defendant’s KRW 58,728,00 for the Plaintiff and its related KRW 5% per annum from September 15, 2014 to July 7, 2017.

Reasons

1. Occurrence of liability for damages;

A. The facts of recognition 1) B are as follows: (a) C bus around 20:40 on September 15, 2014 (hereinafter “Defendant bus”).

B. According to the fact of recognition of liability, the Plaintiff was injured due to the operation of the Defendant bus, and the Defendant is liable to compensate the Plaintiff for the damages incurred by the Plaintiff as the mutual aid business operator of the Defendant bus, barring any special circumstance.

C. The limitation of liability, however, even though the plaintiff was proceeding on a bend road as well as the plaintiff was in operation of a yellow-off signal at the front bank intersection, and thus, he was obligated to drive the bend road at the right speed and to reduce the speed, and even though he was found to turn left at the front bank intersection, he proceeded without reducing the speed by changing the vehicle from two lanes to one lane on the front bank road, and even though he was found to turn left at the right speed, he did not operate the steering gear properly due to the speed of the front bank, and came to conflict with the rear of the defendant bus.

Since the Plaintiff’s error contributed to the occurrence of the instant accident and the expansion of damages, it shall be taken into account, but the Defendant bus entered the lawsuit and left to the left.
