The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for not more than ten months.
1. The sentence imposed by the court below on the defendant (one year of imprisonment) is too unreasonable.
2. Before deciding on the grounds for appeal by the prosecutor's ex officio, the Prosecutor changed "Violation of the Punishment of Violences, etc. Act (Habitual Damage, etc.)" from among the names of the crimes in the trial of the party to "property damage"; Article 2 (1) 1 of the Punishment of Violences, etc. Act (amended by Act No. 2010, Jan. 1, 200) applies for the amendment of an indictment to delete "the content of deletion"; since this court permitted it and changed the subject of the judgment, the judgment of the court below was no longer maintained.
3. Thus, the judgment of the court below is reversed in accordance with Article 364 (2) of the Criminal Procedure Act without examining the defendant's unfair argument of sentencing, and the judgment below is reversed and it is again decided as follows after pleading.
