1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
On December 5, 2016, this Court ordered the Plaintiff to provide litigation costs pursuant to Article 117(2) and (1) of the Civil Procedure Act, which became final and conclusive on July 27, 2017 through the appellate court (Seoul Central District Court Order 2016Ra2145, April 28, 2017) and the reappeal (Supreme Court Order 2017Ma649, July 27, 2017).
The plaintiff did not provide a security within the period of providing a security in the order to provide litigation costs.
Therefore, the lawsuit of this case is dismissed without going through pleadings as stipulated in the main text of Article 124 of the Civil Procedure Act.
