A defendant shall be punished by imprisonment for not less than one year and six months.
Criminal facts
1. Fraud;
A. On August 29, 2011, the Defendant made a false statement to the victim E that “I would repay any more money if you lend the money,” at a Moel where the name of the wife of the D Hospital located in Daegu-gu, Daegu-gu, would not be known.”
However, in fact, the defendant did not own his own property at the time, and did not have any income due to the absence of a certain occupation, so even if he borrowed money from the victim, he did not have the intention or ability to pay it normally
The defendant obtained 5920,000 won from the victim around that time, and acquired it by fraud.
B. Around August 31, 2011, the Defendant made a false statement to the above victim stating, “The Defendant sought a house to be sent to the same person, and borrowed money necessary to purchase the house between three times, and would repay the debt.”
However, the defendant did not have any income due to the absence of a certain occupation as above, and even if he borrowed money from the victim, he did not have the intent or ability to pay it normally.
The Defendant received a cash card from the victim's name (Account Number:F) from the victim, and obtained 11.2 million won by directly withdrawing it from the cash payment machine through this mold.
2. Around November 20, 2011, the Defendant assaulted the victim’s face and chest at a time on the drinking, without reliance on the following: (a) the Defendant did not seem to have shown that the said victim E (30 years of age) was a shower for female friendlys of the Defendant, in which the said victim E (30 years of age) was playing, but did not believe it; (b) the Defendant did not seem to have been able to have seen a shower for female friendlys of the Defendant.
3. On December 1, 201, the Defendant violated the Punishment of Violences, etc. Act (injury by collective action, deadly weapons, etc.), five times the son’s son’s son’s son’s son’s son’s son’s son’s son’s gate 102, and the victim E (30 years of age) was changed from the above measure. The victim’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son.
