The prosecution of this case is dismissed.
Reasons
1. 공소사실 피고인은 2019. 5. 4. 21:05경 서울 동대문구 B 앞 도로에서, 술에 취하여 자신의 단골 가게인 떡볶이 집 사장에게 피해자 C(70세)이 욕설을 하였다고 착오하고, 피해자의 몸을 머리로 들이받고 손에 들고 있던 플라스틱 컵으로 피해자의 오른쪽 귀 부위를 1회 때려 피해자를 폭행하였다.
2. Determination
(a) Applicable provisions of Acts: Article 260 (1) of the Criminal Act;
(b) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act.
C. A written agreement on August 27, 2019 stating that the victim would not want punishment against the defendant was submitted to this court.
