Examining various circumstances that form the conditions for sentencing indicated in the records, such as the Defendant’s age character and character environment, history of the crime, relationship with the victims, motive and consequence of the crime of this case, and the circumstances after the crime, there are significant grounds to recognize that the lower court’s sentencing of the Defendant, which maintained the first instance judgment that sentenced the Defendant to ten years’ imprisonment, was extremely unfair even when considering the circumstances asserted by the Defendant and the national defense counsel.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
