A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
"2019 Highest 413"
1. On June 2018, the Defendant: (a) discovered one driver’s license in the name of the victim B on the road located in the Gangseo-gun Eup Eup/Myeon; (b) returned it to the victim; or (c) reported the acquisition thereof to the nearby police station; and (d) carried it around without following necessary procedures.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. On November 15, 2018, at around 09:00, the Defendant: (a) leased a vehicle at the Drench Office located in the Daren-gun, Gangwon-do (U.S.); (b) voluntarily signed on the lessee’s name column by stating “B”, “E”, “F”, and “F” in the address column in the name of the lease agreement printed out; and (c) as above, the Defendant sent the forged vehicle lease contract to the Drenk office employees in the name of the Dorenk-gun.
For the purpose of exercising, the Defendant forged and exercised the vehicle lease contract in the name of B, which is a private document on rights and obligations.
3. The unlawful uttering of official document presented the driver's license of B, which was obtained and held in the name of the Hancheon-gun, the official document, as stated in Paragraph 2, as if he were B, at the time and place specified in Paragraph 2, to the staff of the Drenk Office.
4. Around 09:00 on November 15, 2018, the Defendant was driving a HM5 vehicle at a section of approximately 120km without a vehicle driver’s license, from the Drenk Office located in Gangwon-gun C to the Chuncheon District Court located in 284, an official announcement in Chuncheon-gun C, via the said Drenk Office, to the said Drenk Office.
The defendant is a person who was detained on May 10, 2019 by violating the Road Traffic Act (unlicensed Driving) at the Chuncheon District Court's original branch on May 10, 2019 and is currently pending trial.
