2. Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive;

On August 16, 2011, the Defendant was employed by D Co., Ltd. located in Daegu-gun Group C and has been working as a quality control team employee until now, and has requested a public institution to conduct testing and analysis on the change-speed cover installed in K9 U.S. supplied to E, a main trading company, and submitted the results received from a public institution to E.

1. On April 12, 2012, the Defendant changed the results of the examination requested by the Korea Testing and Research Institute (TAT-02877) to “283” using a computer program, and then changed five files of the test report under the name of the president of the Korea Testing and Research Institute (TT-02877) from “243” to “283, although the numerical value requested by the Korea Testing and Research Institute fails to meet the necessary numerical value for delivery. From that time to February 25, 2013, the Defendant changed five files of the test report under the name of the president of the Korea Testing and Research Institute (TA-02877) from “243.”

2. On April 12, 2012, the Defendant: (a) supplied e-mail cover with the above e-mail cover at the office of the said D Co., Ltd.; and (b) transmitted the altered test report file to e-mail after undergoing the quality inspection; and (c) exercised five preliminary records by transmitting the modified test report in the same manner as indicated in the annexed crime list from February 25, 2013 to February 25, 2013.

3. From April 12, 2012, the Defendant’s interference with business and fraud: (a) in the office of the said D D Co., Ltd., the Defendant supplied the victim E with the above dynamic cover, despite that the test result did not meet the necessary numerical value; and (b) under the quality inspection, the Defendant sent the changed test result file to the victim E, and then transmitted it.
