Defendant shall be punished by a fine of KRW 7,000,000.
When the defendant does not pay the above fine, 100,000 won.
Punishment of the crime
The Defendant is the actual representative of “E” Co., Ltd. (hereinafter referred to as “E”) located in Jeju-si.
1. From November 30, 2012 to April 24, 2013, the Defendant: (a) borrowed KRW 1,949,000,00 as collateral the factory buildings and machinery equipment owned by the “E” from the branch of the Victim Chungcheongbuk-do branch; and (b) the victim set a joint collateral security right on the said factory buildings and machinery equipment.
From around September 2012 to October 23, 2013, the Defendant moved the aforementioned “E” type of automatic package machines equivalent to KRW 92,800,000, the market price of which was established as the right to collateral security over several occasions, and KRW 83,520,00, KRW 16,732,00, KRW 16,00, KRW 2,000, KRW 30, KRW 00, KRW 40, KRW 00, KRW 40, KRW 00, KRW 00, KRW 16,732,00, KRW 16,000, KRW 40, KRW 00, KRW 5,000, KRW 5,000, KRW 5,000, KRW 0, KRW 16,000, KRW 40, KRW 06, KRW 40,000, KRW 5,05,00.
2. The Defendant who violated the Subsidy Management Act stated in the indictment of the Korea Occupational Safety and Health Agency around 2014 as the “Korea Occupational Safety and Health Agency” but is deemed to be a clerical error.
The F applied for “F”, and received subsidies of KRW 19,770,000 from the Korea Industrial Safety and Health Corporation on January 22, 2015 for the purchase of industrial machinery and equipment, such as forkives, from the Korea Industrial Safety and Health Corporation, as the Agricultural Cooperative Account in the name of E.
A subsidized project operator shall faithfully perform the subsidized project with the care of a good manager in accordance with statutes, the details of the decision to grant subsidies, or the disposition of the head of a central government office under statutes, and shall not use the subsidy for any other purpose.
