1. The defendant shall pay 40 million won to the plaintiff and 12% per annum from July 3, 2019 to the day of complete payment.
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment without holding any pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. The provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal (hereinafter “the provision”) was amended on May 21, 2019 and came into force on June 1, 2019, and was in force on June 1, 2019. However, according to the Addenda to the amended provision, 12% per annum, which is the statutory interest rate under the amended provision, is applicable from June 1, 2019, and thus, the part on delay damages in excess is rejected.
