1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by each person;
The defendant asserts to the effect that the lawsuit of this case is unlawful, since he/she received a decision to grant bankruptcy or immunity.
In light of the overall purport of the arguments in the evidence Nos. 1 through 5, the defendant is recognized as declared bankrupt and granted immunity by the Seoul Central District Court No. 2013Hadan8567, 2013, 2013, 85667, after the occurrence of the claim on the ground of the attached sheet (hereinafter “instant claim”).
Therefore, barring special circumstances, the instant claim is unlawful as there is no benefit of protection of rights, since the right and executory power of filing a lawsuit is lost, barring special circumstances.
Thus, the lawsuit of this case is unlawful and dismissed.
