1. The Defendant shall pay to the Plaintiff KRW 38,242,251 and the interest rate of KRW 15% per annum from December 9, 2017 to the date of complete payment.
Reasons
As of February 11, 2015, the Plaintiff supplied leathers, etc. to Defendant (hereinafter “B”) by February 11, 2015, and as of May 4, 2016, the fact that the proceeds of the attempted goods remain in KRW 38,242,251 remains does not conflict between the parties.
Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from December 9, 2017 to the day of full payment, which is the day following the delivery of the complaint filed by the Plaintiff.
