1. The Defendant shall pay to the Plaintiff KRW 100,000,000 as well as 24% per annum from March 31, 2018 to the date of full payment.
Reasons
1. The description of the grounds for the claim shall be as specified in the attached Form;
2. Article 208 (3) 1 of the Civil Procedure Act of the applicable provisions of Acts;
3. 일부 기각 부분(약정 이자) 원고 주장 약정 이율은 연 24%이고, 원고 스스로 이자 8,500,000원을 지급받았음을 인정하고 있는바, 위 8,500,000원은 2017. 11. 23.부터 2018. 3. 30.까지의 이자{≒100,000,000원×0.24×(4 8/31)}에 충당되므로, 2018. 3. 9.부터 2018. 3. 30.까지의 약정 이자 청구 부분을 기각함.
