The plaintiff filed a lawsuit against the defendant to "the defendant shall pay to the plaintiff 697,826,069 won with 18% per annum from September 24, 2004 to March 31, 2005, and 20% per annum from the next day to the day of full payment" (Seoul Central District Court Decision 2004Gahap80729 delivered on March 31, 2005). The above judgment was finalized on June 22, 2005.

As of October 27, 2014, the above obligation remains a total of KRW 3,092,670,463 (i.e., principal amount of KRW 697,826,069, interest of KRW 2,394,844,394).

The Plaintiff filed the instant lawsuit for the interruption of extinctive prescription.

(However, with respect to damages for delay from October 28, 2014, only KRW 500 million out of the principal shall be claimed. Article 208(3)1 and Article 257(1) of the Civil Procedure Act of the applicable provisions of the Acts (a judgment without presentation of a written reply)
