As to the Plaintiff, the Defendant: (a) 942m2 of the store site in Kimpo-si:
(a)for the purposes of the Schedule 3, 4, 5, 6, 7, 8, 9, respectively;
Facts of recognition
A. On January 8, 2018, the Plaintiff purchased 942 square meters (i.e., the land category was changed to a warehouse site, regardless of whether it was before or after the change of land category; hereinafter “instant land”) before Kimpo-si and completed the registration of ownership transfer on March 2, 2018.
B. The Defendant, as the owner of two lots, not less than 4,683§³, adjacent to the instant land, constructed a reinforced concrete structure sloping roof, a store of 330 square meters on the said ground (hereinafter “Defendant warehouse”), and completed the registration of initial ownership on May 29, 195.
C. According to the result of the appraiser's survey and appraisal entrusted by this court, the retaining wall and steel fence in the defendant's warehouse are installed on the line connected each point of the attached Form 3, 4, 5, 6, 7, 8, and 9 with respect to the land of this case, and the outer wall of the defendant's warehouse is located on one square meter of each part of the ship connected each point of 17, 18, and 19 in order of the same drawing indication (hereinafter referred to as "section A land"), and the outer wall of the defendant's warehouse is located on one square meter of each part of the ship's warehouse connected each point of 21, 17, 19, 20, and 21 square meters of the same drawing indication (hereinafter referred to as "section B") in one square meter of each part of the ship's warehouse connected each point of 23, 24, 25, 26, and 23 in turn.
According to the result of appraisal of the appraiser's land by entrustment of this Court, among the land in this case, the amount equivalent to the rent of 3,4,5,6,7,8,8,9,27,26,23,22,20,19,18, 17, 2, 3, and 77 square meters of the portion 1,2, 3, and 44(hereinafter referred to as "the portion 1,22, 3, and 44(hereinafter referred to as "the land 1, 2, 3, and 4) connected in order to each of the items 3, 4, 6, 7, 8, 9, 27, 26, 23, 22, 20, 19, 18, 17, 21, and 3 shall be assessed as KRW 70,000 per month.
