A. A. Around April 16, 1999, Nonparty B entered into an insurance contract for cancer insurance (hereinafter “instant insurance”) in the attached Table No. 2 stating that the period of insurance between the Plaintiff and the Defendant as the insured was from April 16, 1999 to April 16, 2014.

B. Around March 19, 2014, the Defendant received an ultra-frequency test and a blood test (AFP, PIVKII II) from the members of the Department located in Yangsan-si, and as a result, from the PIVK II prosecutor to the PIVA II, the result of the PIVK II prosecutor exceeding 40mAU/mL, exceeding 109mAU/mL, 105mAU/mL, and the result of the 105mAU/mL, from the members of the Department located in D, the Defendant was diagnosed as the early liver cancer and transferred the Defendant to the university hospital.

C. Around April 22, 2014, the Defendant was finally diagnosed liver cell cancer as a result of the CT shooting at the Yangsan National University Hospital, and there was an opinion that there was a liveration and a 2.4 cm inter-cell cancer of the size of 2.4 cm between the base and May 15, 2014. < Amended by Presidential Decree No. 25358, May 28, 2014>

The terms and conditions of the instant insurance are as follows.

Article 3 (Compensation for Loss) If any of the following events occurs to the insured after the commencement date of liability for cancer prescribed in paragraph 1 of 7. insurance period, the company shall guarantee the insured in accordance with this Clause:

(1) When the insured has been diagnosed and confirmed after the starting date of responsibility for cancer security, the diagnosis and confirmation of the specific cancer, general cancer, or clinical pathology under Article 4 (4) (4) shall be conducted by a person who holds a professional doctor's license of the autopsy pathology or clinical pathology, and this diagnosis shall be based on the present and present opinion of the tissue or blood test.
