1. Facts of recognition;
가. 피고는 비닐하우스를 신축하여 농사를 짓기 위해 2009년 5월경 원고로부터 진주시 C 답 2,998㎡ 및 D 답 1,630㎡(이하 위 각 토지를 ‘이 사건 각 토지’라 한다)를 차임 연 270만 원, 임대차기간 5년으로 정하여 임차하였고, 그 무렵부터 이 사건 각 토지 중 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉤, ㉥, ㉦, ㉠의 각 점을 차례로 연결한 선내 부분 3,600㎡ 지상에 있는 비닐하우스(이하 ‘이 사건 비닐하우스’라 한다)를 소유한 채 농사를 지어왔다.
B. On August 1, 2014, the Plaintiff concluded a lease agreement with the Defendant by setting the period of KRW 3750,000 per annum and the period of lease as of July 30, 2016, and concluded the lease agreement, and the Defendant agreed to remove the instant vinyl. On June 30, 2016, the Plaintiff extended the period of lease with the Defendant until May 31, 2017.

According to the facts established prior to the determination on the cause of the claim, the lease contract between the Plaintiff and the Defendant terminated on or after June 1, 2017, the Defendant is obligated to remove the instant vinyl house to the Plaintiff and deliver each of the instant land to the Plaintiff, and pay the Plaintiff the amount of unjust enrichment equivalent to the rent calculated at the rate of KRW 3,750,000 per annum from June 1, 2017 to the completion date of delivery of each of the instant land.
In this regard, the defendant argued that the plaintiff and the term of lease extended from the greenhouse of this case to June 30, 2017, the defendant paid the rent until that time. However, since it is difficult to find evidence to recognize it, the above argument by the defendant is without merit.
3. In conclusion, the plaintiff's claim is reasonable, and it is so decided as per Disposition.
