1. The defendant shall pay 28,00,000 won to the plaintiff and 20% per annum from March 19, 2015 to the day of complete payment.
Around August 2014, the Plaintiff entered into a construction contract with the Defendant and the Plaintiff, which concluded a contract with the Plaintiff for construction cost of KRW 588,00,000,000, and completed the construction. The Defendant did not pay the Plaintiff KRW 28,00,000 out of the construction cost. There is no dispute between the parties.
According to the above facts of recognition, the defendant is obligated to pay to the plaintiff 28,00,000 won for the unpaid construction price and damages for delay calculated at the rate of 20% per annum from March 19, 2015 to the date of full payment, which is the following day after the copy of the complaint of this case was served on the defendant.
If so, the plaintiff's claim shall be accepted for the reasons and it is so decided as per Disposition.
