Punishment of the crime
The defendant is the representative director of C corporation that engages in trade business and wholesale and retail business for infant goods located in No. 403 of the fourth floor of Incheon Gyeyang-gu building B.
The Defendant, from around July 2011, imported home diapers from China to supplied them to domestic sales business, accumulated the burden of waste charges on diapers imported diapers due to the increase of waste charges, exchange rate fluctuations, etc., with the intent to gain pecuniary benefits by evading the value of the value of the value that should be paid by falsely reporting the amount of revenue at the time of filing an import declaration on July 201.
1. On July 12, 2012, the Defendant in violation of the Customs Act due to false declaration imported from the Chinese “D” company from the Chinese “D, and filed a false declaration of import price to USD 24,58.84, even though the import price of the said base return was USD 35,026, while the import price of the said base return was US$ 35,026.
In addition, from around August 12, 2013 to around August 12, 2013, the Defendant falsely reported the import price of USD 2,991,650 in total ($ 3,378,695,941, market price 5,020,350,580) on 47 occasions, such as the list of crimes in violation of the Customs Act (False Declaration).
Accordingly, the defendant filed a false declaration of the price of the goods while importing the goods.
2. Around August 19, 2013, the Defendant violated the Customs Act due to price manipulation imported 3,585CT from the Chinese “D” company to the import declaration number of 3,585C for young children, and the fact was that the import price of the said diaper was USD 90,532.80, but the import price was 71,626, and the false invoice was submitted.
In addition, from that time until February 25, 2015, the Defendant is equivalent to USD 3,627,913 ($3,889,557,533, and market price 5,779,431,69) in total on 74 occasions, such as the list of crimes in violation of the Customs Duties Act (price manipulation).
