1. Basic facts
A. The Plaintiff of the parties, etc. is a trust company that owned the instant building and its site in trust from the Scar Leisure Industry Co., Ltd. (hereinafter “Scar Leisure Industry”) that implemented the construction and membership sale business of the real estate listed in the attached list (hereinafter “instant building”).
The Defendant is a company that registered its business at the location of the instant building and operates a different set of books, “Yices Hotel & Rit” in the instant building.
Alley Asset Management Co., Ltd. (hereinafter referred to as “Alley Asset Management”) is a company that took over all the contractual status of a lender or a secured party against a company, a company that borrowed business funds, such as the construction of the building of this case, to the Scar Leisure Industry, the loans on the Scar Leisure Industry and the beneficial rights under the trust agreement of the Scar Leisure Industry.
B. 1) On August 16, 2013, the Plaintiff entered into the instant lease agreement with the Defendant to lease the instant building to the Defendant as follows (hereinafter “instant lease agreement”).
2) A party to the instant lease agreement was a party to the instant lease agreement, regardless of whether a party to the instant lease agreement was a lessor’s interested party.
A) Around that time, the Defendant received KRW 300,000,000 as the down payment for the lease deposit. Article 4 (Rental Deposit)
1. The deposit for lease shall be the sum of KRW 3,00,000 (Won 3,000,000) and the “B” (the defendant refers to the defendant; hereinafter the same shall apply) shall pay to “A” (the plaintiff refers to the plaintiff; hereinafter the same shall apply) as follows:
(1) The down payment, daily payment, KRW 300,000,000 (Won 2,700,000) shall be the balance (Won 2,700,000,000) at the time of the conclusion of the contract, and Article 5 (Monthly Rent, etc.) shall be the date of completion of the execution of surrender.
1. “B” shall be the monthly rent of 30,000,000 won (Won 30,000,000) at the last day of each month.
