Article 3(1) main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal was promulgated on September 25, 2015 as amended and enforced on October 1, 2015, and Article 2(2) of the Addenda of the Act on Special Cases concerning the Promotion, etc. of Legal Proceedings (Presidential Decree No. 26553) provides that “The interest rate under the former provisions shall be the interest rate until September 30, 2015 with respect to cases in which the first instance trial is pending in court at the time this Decree enters into force, and the interest rate under the former provisions shall be the rate under the amended provisions of this Decree from October 1, 2015 to September 30, 2015, and damages for delay shall be dismissed by the day immediately following the date of full payment.”
