1. The plaintiff's primary claim and the conjunctive claim are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. The parties' assertion
A. On December 30, 1974, the land indicated in the Plaintiff’s argument list (hereinafter “instant road”) divided the land of the instant parcel into several lots of land and changed its land category into a road that enters each house from the public road to use it as a road for entering each house. On December 30, 1974, when the I transferred the instant road to Nonparty K, 4.3/36.7 shares (hereinafter “instant co-ownership shares”) among the instant road (hereinafter “instant land”) at the time of transfer to Nonparty K of the instant land to transfer the instant land to L, but L transferred the instant co-ownership shares, although L sold the instant land and the instant co-ownership shares to Defendant C on March 17, 1984, omitted the registration of ownership transfer with respect to the instant co-ownership.
After that, L died on October 23, 2013.
Therefore, Defendant B, Appointers D, E, F, G, and H, the primary heir of the deceased L, have a duty to implement the registration procedure for transfer of ownership on March 17, 1984 with respect to the instant co-ownership share.
Even if it is not so, Defendant C and the Plaintiff continued to occupy and use the instant road as the road along with the owner of the neighboring house after March 17, 1984, and accordingly, Defendant C and the Plaintiff are obligated to implement the registration procedure for transfer of ownership on January 1, 2007, after the lapse of 20 years from January 1, 1987 (or from January 1, 1984, on the ground that there was no change in the owner of the instant co-ownership after March 17, 1984, on the ground that the Plaintiff was arbitrarily designated as the owner of the instant co-ownership).
B. The Selection Party did not sell the instant co-ownership to Defendant C, and even if Defendant C purchased the said shares on March 17, 1984, the instant lawsuit is filed.
