Examining the reasoning in light of the evidence duly admitted by the court below, the court below was just to have determined that the facts charged in this case was guilty (except for the part concerning acquittal in the grounds of appeal), and there was no error in the misapprehension of the legal principle as to the "profit accrued from a violation" under the proviso of Article 443 (1) and (2) of the Financial Investment Services and Capital Markets Act, contrary to the allegations

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
