1. Basic facts

A. On June 27, 2003, the Plaintiff acquired the instant land as a public sale, and completed each registration of ownership transfer on July 28, 2003, on which the Plaintiff acquired the instant land of 2,707 square meters, PJ 820 square meters, QJ 721 square meters, and RJ 694 square meters (hereinafter “instant land”).

B. Defendant B, Appointed C, D, E, F, G, H, I, and J owned each of the instant buildings constructed on the instant land and occupied the relevant site. The location of each of the instant buildings and its site are as follows.

1) 피고 B은 경북 봉화군 S 대 2,707㎡ 지상에 건축된 별지 건물감정도 표시 30, 31, 32, 33, 30의 각 점을 순차로 연결한 선내 (다)부분 목조 화장실 12㎡, 별지 건물감정도 표시 34, 35, 36, 37, 38, 39, 40, 41, 34의 각 점을 순차로 연결한 선내 (라)부분 목조 주택 252㎡, S 대 2,707㎡ 및 Q 대 721㎡ 지상에 건축된 별지 건물감정도 표시 103, 104, 105, 106, 107, 108, 109, 110, 111, 112, 103의 각 점을 순차로 연결한 선내 (가¹)부분 목조 주택 32㎡, Q 대 721㎡ 지상에 건축된 별지 건물감정도 표시 113, 114, 115, 116, 113의 각 점을 순차로 연결한 선내 (나¹)부분 목조 화장실 7㎡, 별지 건물감정도 표시 117, 118, 119, 120, 121, 122, 123, 124, 117의 각 점을 순차로 연결한 선내 (다¹)부분 목조 문간채 66㎡(이하 ‘이 사건 고택’이라고 한다

2) The Selected owns the portion (i) part (i) of the attached Table 1, which connects 27, 28, 29, 40, 39, 38, 41, 42, 43, and 27 square meters on the ground of 241 square meters in sequence, among the annexed Table 2,707 square meters in Pyeongtaek-gun, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-do, in order, to each point of 27, 28, 29, 40, 41, 42, 43, and 61, 62, 63, 64, 65, 66, 67, 68, 69, 70 square meters on the ground of 241 square meters in order.
